Definitions and Terms

Banica Joaillier - BANICA GROUPE SRL, whose registered office is Val des Seigneurs 11b in 1150 Brussels, with company number 0745623756.

The buyer - a natural person opening an Account on the site and placing an Order.

Order - an electronic document acting as a form of communication between the Seller and the Buyer through which the Buyer transmits to the Seller, through the Site, his intention to purchase Goods on the Site.

Goods - Any product, including the documents and services entered in the Order which will be provided by the Seller to the Buyer following the Contract concluded.

Campaign - the act of exhibiting for commercial purposes a finite number of Goods of which the stock is limited and predefined, for a limited period of time established by the Seller.

Contract - represents the distance contract concluded between the Seller and the Buyer, without the simultaneous physical presence of the Seller and the Buyer.

Question - formula to address other Users / Customers / Buyers with the aim of obtaining information on the products of the page in question.

Response - written information that is sent to the User / Customer / Buyer who has made a Question on the Site, on the page of a certain product. The response represents an explanation offered by one User / Customer / Buyer to another User / Customer / Buyer in the context of a discussion.

Document - these Terms and Conditions.

Newsletter - periodical, exclusively electronic means of information, respectively electronic mail (email, SMS) concerning the Goods and Services and / or promotions carried out by the Seller over a certain period, without any commitment from the Seller relating to the information contained.

Transaction - collection or reimbursement of a sum resulting from the sale of a Good and / or Service by BANICA GROUPE SRL to the Buyer, using the services of the company responsible for processing the cards, approved by the Seller, whatever 'it is the mode of delivery.

Specifications - any specifications and / or descriptions of Goods and Services, as specified in their description.


2. Contractual documents

2.1. By registering an Order on the Site, the Buyer agrees with regard to the form of communication (by phone or email) through which the Seller conducts its business operations.

2.2. The notification received by the Purchaser after placing the Order plays an informational role and does not represent acceptance of the Order. This notification is done electrically (email) or by telephone.

2.3. For justified reasons, the Seller reserves the right to modify the quantity of the Goods in the Order. 2.4. The contract will be considered as concluded between the Seller and the Buyer upon receipt by the Buyer from the Seller, through the e-mail and / or SMS of the notification of dispatch of the Order.

2.5. The contract will be concluded on the basis of the document and the information made available by the Seller on the Site, being supplemented by the certificate of authenticity issued by the Seller for the Goods purchased.


3. Online sales policy

3.4. BANICA GROUPE SRL. may publish on the Site information on the Goods and / or promotions that it practices or that are practiced by any other third party with which SC Le Ruban SRL has concluded partnership contracts, over a certain period of time and within the limit of Available stock.

3.5. All prices relating to the Goods presented on the Site are expressed in EURO including tax.

3.6. 4. Assignment and subcontracting

The seller may assign and / or subcontract to third parties the Services relating to the delivery of the Order, with prior information to the Buyer, without the latter having to express his agreement. The seller will always be responsible to the Buyer for all contractual obligations.


5. Intellectual and industrial property rights


5.1. 5.3. 5.6. 6. The order


6.1. The Customer / Buyer can place Orders on the Site, by adding the desired Goods to the basket, by finalizing the Order by choosing the method of payment among those expressly indicated for this purpose. 6.3. By finalizing the Order, the Buyer agrees that the Seller can contact him, by any means available / approved by the Seller, in any situation where it is necessary to contact the Buyer.

6.4. The seller may cancel the Order placed by the Buyer, following a prior notification addressed to the latter, without any subsequent obligation of any of the parties towards the other or without any of the parties being able to claim the right to do so. '' other damages in the following cases:

9. Advertising

10. Invoicing - Payment

3. Payment by bank transfer

11. Delivery of goods

Delivery will be made within 24 - 48 hours from the confirmation of the order, with the exception of Saturdays and Sundays, as well as public holidays.

When does the ordered jewelry arrive?

The service provider will prepare for delivery the orders destined for Romania, according to the following times:

There may be exceptional situations, when the ordered product is no longer in stock when ordering or will be brought to order from the external supplier's stock. Products that are not in stock at a certain time will be delivered within 30 days at the latest, within the limit of the stock available in the factory.

The price of the product delivered to order may be subject to modifications compared to the price displayed when the order is placed, something which will be brought to your attention by the operators BANICA GROUPE SRL concerning the delivery times and / or the price modification, before confirmation of the order;

Before ordering a product, please check if it is in stock. Products that are not currently in stock cannot be delivered. 11.3. The seller will deliver the Goods exclusively on the territory of Romania within a maximum period of 3 working days by DHL and DPD.



12. Guarantees and authenticity

12.2. The warranty certificate attests that the products meet the parameters and quality requirements in accordance with international standards corresponding to the class in which they are framed. They benefit from a guarantee provided that the rules of use are respected. The warranty period is 30 days from the day of acquisition. Products with manufacturing defects will be replaced, unless they have already been worn. The warranty does not cover products with defects caused by negligence or improper use, without any connection with possible manufacturing or workmanship defects. If the jewel cannot be repaired, at the buyer's choice, the damaged jewel can be replaced by a similar model. This guarantee attests to the fact that the jewel does not change its properties if used correctly. For jewelry with stones (diamonds, precious and semi-precious stones, zircon, rhinestones), if they fall, the manufacturer or the seller will replace them within a reasonable period of 14 working days. Repairs in cases not covered by this warranty will be charged to the purchaser.


Precautions and recommendations:


at. We recommend that you protect jewelry from possible shocks, gently open bracelets, earrings and necklaces;

b. Jewelery encrusted with stones or pearls should be worn with care because the setting cannot withstand mechanical shocks.

vs. The jewelry must be removed before taking a bath, washing the dishes or before any other similar activity during which the jewelry could come into contact with water, detergents, cosmetics and chemicals. The natural oil in the skin can help maintain the shine of the pearls, however, the acid from the sweat can attack and discolor the pearl.

d. The beads will be kept separately in your jewelry box. Avoid storing them with other jewelry or harder stones;

e. The precious metal may lose some of its luster over time if it comes into frequent contact with external agents.



13. Transfer of ownership of goods

Ownership of the Goods will be transferred upon delivery, after payment has been made by the buyer, to the place indicated in the Order (delivery resulting in the signature of receipt of the transport document provided by the carrier or the receipt signature on the tax invoice for deliveries made by the Seller's personnel).



14. Liability

14.1. The seller will not be held liable for damages of any kind whatsoever that the Buyer or any other third party may suffer as a result of the performance by the Seller of any of its obligations, in accordance with the Order or for damage resulting from the use of the Goods after delivery and in particular for the loss of the goods.

14.2. By creating and using the Account, the Client / User / Buyer accepts responsibility for the confidentiality of Account data (user and password) and for managing access to the Account and, under reserve of legality, for the activity carried out through his Account.

14.3. By creating the Account and / or using the Content and / or placing Orders, the Customer / User / Buyer expressly and unequivocally accepts the Terms and Conditions of the Site in the latest updated version which is communicated on the Site, on the day of the creation of the Account and / or use of the content and / or when the order is placed.

14.4. Subsequent to the setting up of the Account, the use of the Content is equivalent to the acceptance of the modifications made in the Terms and Conditions of the Site and / or of the updated versions of the Terms and Conditions of the Site.

14.5. The terms and Conditions of the Site may be modified at any time by BANICA GROUPE SRL, these being enforceable against Customers / Users / Buyers from the date of posting on the Site. The Terms and Conditions of the Site are confirmed by marking the corresponding checkbox of the Site and / or by sending the Order and / or by making an online payment.



15. Registration of Reviews, Comments, Questions and Answers


15.1. Registration of Rewies, Comments, Questions and Answers can be done by Users / Customers / Buyers, in the “customer questions and answers” and “Reviews” sections. The information entered can be positive as well as negative and will relate to the characteristics and mode of use of a product.

15.2. When registering a certain Review / Comment / Question / Answer on the Site, Users / Customers / Buyers grant the Seller a non-exclusive, perpetual, irrevocable license, without territorial limits, opening the right for the Seller to use, reproduce, modify, adapt, publish, translate, distribute and display the content in question.

15.3. Each User / Client / Buyer, when registering a Review / Comment / Question / Answer in the mentioned sections, undertakes to respect the following rules:

- make comments only on the characteristics, avoiding information related to aspects likely to change (price or promotional offers) or information related to the way in which the Order is processed;

- use only French. Also accepted are words or expressions which, although not considered Romanian, are widely used in circles in the field in question (for example: mouse, notebook, plug and play)

- to use correct, non-offensive language, without terms likely to offend or affect any other User / Client / Buyer;

- ensure that the content introduced on the site is properly framed, therefore: any Question will be entered in the “Customer Questions and Answers” section and any Reviews will be entered in the “Reviews” section;

- ensure that the information they have entered is realistic, correct and not misleading and that they comply with applicable laws, thus respecting the rights of other parties, copyright, trademark, license or other property rights, publicity and privacy;

- use this facility only for the purpose of communicating or obtaining additional details regarding certain product or service of the Site, without reference to other companies promoting the sale and purchase of products or services;

- not to provide or request, in any way whatsoever, personal data (contact details, information on the delivery or home address, telephone numbers, e-mail addresses, name and / or first name, etc. .) or any other information that may lead to the disclosure of this personal data;

- not to enter information and / or details on the URLs (links) of other commercial sites carrying out the same commercial activity as the seller;

- not to try to defraud the services made available by the Seller or not to register a Review / Comment / Question / Answer containing material of an advertising nature;

- not to use the Review / Comment / Question / Answer as a means of communication with the Seller, in this sense he will use the Seller's contact data registered on the Site.


15.4. In addition to a critical realistic rating, when registering for a Review, the Client / User / Buyer will add a significant Rating for the related product or service. Reviews, with the associated ratings, will influence the general rating of the product, the number that appears in brackets next to its title. Thus, a Review accompanied by a high rating leads to an increase in the general Rating, while a Review accompanied by a reduced Rating will lead to a drop in the General Rating.

Users / Customers / buyers registering Reviews to which they attach photo or video files are required to comply with the following rules:

- The uploaded files will contain images and / or videos relating to the product that is the subject of the Review, ensuring that the uploaded files respect copyright;

- Uploaded files will not contain violence, adult content, licentious language or any other content likely to offend a person / group on criteria related to race or ethnicity, religion, disability, gender , age, sexual or political orientation;

- Uploaded files will not contain information about other people;

- Uploaded files will not contain URLs or watermarks sending to sites with the same commercial activity as the Seller.

15.5. When a Review / Comment / Question / Answer is flagged by a User / Customer / buyer for having inappropriate content, from a strictly subjective perspective, that content is carefully reviewed by the Seller to determine if it is inconsistent with the Terms and Site Conditions. The texts, photos or videos introduced are removed from the Site only after having been examined by the Seller.

15.6. If the Seller finds the breach of the Terms and Conditions repeatedly, he reserves the right to suspend the possibility of the User / Customer / Buyer to enter Review / Comment / Question / Answer in the sections "Questions and answers of clients ”and“ Reviews ”.

For complaints and observations relating to the Good purchased, Buyers have at their disposal the observations form on the Site: www.banica.be or the possibility of sending an e-mail to the address: info@banica.be . The maximum time limit for processing and resolving complaints or observations is 30 calendar days following their receipt.


16. Processing of personal data

16.1. SC Le Ruban SRL is registered in the Personal Data Processing Register.

According to the updated Law 677/2001, for the protection of individuals with regard to the processing of personal data and the free movement of such data, as amended and supplemented, BANICA GROUPE SRL has the obligation to manage in security conditions and exclusively for the specified purposes, the personal data that you put at our disposal.

16.3. The purpose of data collection is as follows:

- Inform Customers / Buyers of the status of their Account, including the validation, dispatch and invoicing of Orders, resolve cancellations and any other problem whatsoever concerning an Order, the Goods and / or the services acquired,

- Send newsletters and / or periodic alerts, using electronic mail (email, SMS)

- Market research, follow-up and monitoring of sales and Client / Buyer behavior,

16.4. By completing the Account and / or order creation form, the Purchaser declares and accepts unconditionally that his data is included in the database of BANICA GROUPE SRL, registered in the Personal Processing Register and gives his express consent. and unambiguous so that these personal data are stored, used and processed for the purposes mentioned above in point 16.3.

16.5. By reading the Document, you have become aware of the fact that your rights are guaranteed by law, respectively the right to information, access to data, the right to intervene, the right to oppose, the right not to be exposed to any individual decision, the right to go to court in the event of breach of the rights guaranteed by Law 677/2001 for the protection of individuals with regard to the processing of personal data and the free movement of such data.

16.6. On the basis of a written request, dated, signed and sent to the following address: Val des Seigneurs 11b at 1150 Brussels, Belgium for the attention of BANICA GROUPE SRL, you can exercise free of charge, due to a solicitation per year, the right to obtain confirmation whether or not your personal data is being processed.

16.7. On the basis of a written, dated, signed and sent request to the following address: Val des Seigneurs 11b at 1150 Brussels, Belgium for the attention of BANICA GROUPE SRL, you can exercise your right to intervene on the data, as following :

16.7.1.Rectification, updating, blocking or deletion of data the processing of which does not comply with Law 677/2001 for the protection of individuals with regard to the processing of personal data and the free movement of such data, in particular incomplete or inaccurate data;

16.7.2.Transformation into anonymous data of data whose processing does not comply with Law 677/2001 for the protection of individuals with regard to the processing of personal data and the free movement of such data;

16.7.3.Notification of third parties to whom the data has been disclosed, unless this notification proves impossible or requires a disproportionate effort in relation to the legitimate interest which could be harmed;

16.8. In addition, BANICA GROUPE SRL may provide the Buyer's personal data to other companies with which it has partnership relations, but only on the basis of a confidentiality commitment on the part of the latter and only for the purposes mentioned in point 16.3 above, by which it guarantees that these data are kept securely in application of the legislation in force, as follows: provider of shipping and transport services, providers of marketing services, suppliers payment / banking services, telemarketing or other services provided by companies with which we are able to carry out joint marketing programs for our Goods, insurers.

16.9. The Buyer's personal information may also be transferred to the Public Prosecutor's Office, Police, courts and other state bodies, on the basis and within the limits of legal provisions and following requests expressly made in this regard. .



17. Force majeure

17.1. Neither party will be held responsible for the non-performance of its contractual obligations within the time limits provided and / or the poor performance, total or partial, which is due to an event of force majeure. Force majeure is an unforeseeable event, beyond the control of the parties, which cannot be avoided.

17.2. If within 15 (fifteen) days from the day on which it occurred, the event in question does not cease, each party will have the right to notify the other party on the automatic termination of the Contract, without either party being able to demand payment of damages from the other.



18. Applicable law / Jurisdiction

This Contract is governed by Belgian law. Any dispute arising between BANICA GROUPE SRL and the Customers / Buyers will be resolved amicably, otherwise, the disputes will be resolved by the competent Belgian courts of the Brussels court.
